Outline of a Responsibility Hearing

Introduction

Respondent, Complainant, Hearing Officer or Hearing Board members, Student Advisor, Procedural Advisor, and witnesses (if any) introduce themselves - Honesty Oath confirmed at this time by all parties participating in the hearing. Complainant must show that there is a preponderance of evidence that the respondent more likely than not is responsible for the alleged violations. Procedural questions (if any) are addressed at this time.

Response to Charges:

Student has an opportunity to accept responsibility or not, or to not respond at all to the charges as they are read.

Summary Statements from Complainant and Respondent:

All participants leave the room while the Hearing Officer/Board deliberates in private and makes a decision regarding responsibility.

All parties return after the deliberations of the Hearing Officer/Board are concluded. The Hearing Officer or Hearing Board Chairperson then reads the decision.

If a decision of Not Responsible is reached on all charges, then the Hearing Officer or Hearing Board Chairperson gives the rationale for this decision. The Procedural Advisor then concludes the hearing with closing remarks.

If a decision of Responsible is reached then the Hearing Officer or Hearing Board Chairperson gives the rationale for this decision. The sanction discussion begins at this time.

Sanction Discussion:

Complainant gives his/her sanction recommendations and rationale

Respondent gives his/her sanction recommendations and rationale

Discussion commences between Hearing Officer or Hearing Board, Respondent and Complainant in order to determine the most appropriate sanction(s) for the nature of the violation(s).

Conclusion of Hearing:

Procedural Advisor closes the hearing and gives information regarding the appeal process to both the Respondent and Complainant.
