UNH is initiating procedures to comply with the requirements of a Pilot Program for Enhancement of Employee Whistleblower Protection, as authorized by the National Defense Authorization Act ("NDAA") for Fiscal Year 2013 (Pub. L. 112-239, enacted January 2, 2013).  Section 828 of the NDAA adds a new section 4712 to Title 41 of the U.S. Code, which contains the elements of the Pilot Program and suspends the pre-existing whistleblower protections at 41 U.S.C. § 4705 for the duration of the Pilot Program.

The statute states that an “employee of a contractor, subcontractor, grantee [or sub-grantee] may not be discharged, demoted, or otherwise discriminated against as a reprisal for “whistleblowing”, which is defined as disclosure of “information that the employee reasonably believes is evidence of gross mismanagement of a Federal contract or grant, a gross waste of federal funds, abuse of authority relating to a federal contract or grant,  a substantial and specific danger to public health or safety, or a violation of law, rule or regulation related to (including the competition for or negotiation of) a Federal contract  or grant”.  

The Pilot Program requires grantees, subgrantees, contractors, and subcontractors to notify their employees in writing of the rights and remedies provided under the Pilot Program and UNH will soon initiate the first of the required annual notices. 

UNH is committed to ensuring employees cannot be discharged, demoted or otherwise discriminated against as a reprisal for “whistleblowing” alleged gross mismanagement or abuse of a Federal contract or grant.
